Fonseka files writ application challenging the composition of second Court Martial

Retired General Sarath Fonseka Monday filed a Writ Application in the Court of Appeal challenging the composition of the second Court Martial. He has leveled serious allegations against the three Major Generals of the Sri Lanka Army appointed to the Court Martial. He sought the Court of Appeal to quash the hearings of the Court Martial stating that one of the Major Generals was in the pay of the LTTE and the other tried by the SLA for giving false evidence at an inquiry.

General Fonseka has cited Army Commander Jagath Jayasuriya, Court Marshal members Milinda Peiris (president), S.W. Lalith Daulagala, Mahinda Hathurusinghe, Deputy Solicitor General W.J.S Fernando, the judge advocate and the Attorney General as the respondents.

General Fonseka said in his petition that his preliminary objection against the composition of the second court marshal was overruled by the court martial itself.

Hence he has filed the petition in the Appeal Court as the overruling by the court martial is unlawful.

Meanwhile, the second court martial trial involving Gen. Sarath Fonseka which started Monday was postponed to June 3.

Fonseka has been charged with alleged contravention of military procurement in the second court martial.
